Some Analysis of Yesterday’s Arguments Before the Supreme Court in Obamacare Subsidies Case

From questioning today in King v. Burwell, there is quite a buzz that Justice Kennedy appears concerned about whether interpreting the ACA to deny subsidies to citizens of states with federal exchanges would unconstitutionally coerce states to set up their own exchanges.

That was my take after reading and listening to the press coverage. ┬áLeaving me concerned that Kennedy might be the fifth and deciding vote for the Obama administration. ┬áBut after reading some analysis, I am hopeful that will not be the case.
